These terms and conditions (the "Terms and Conditions") are the terms and conditions upon which Todich Floral Design LTD ("we/us") makes available to you any of our products or services. These Terms and Conditions govern your use of Todich Floral design products or /and Services.All business conducted is covered by the following terms and conditions, and shall apply to the exclusion of any other terms and conditions. Changes to terms and conditions may only be effective if agreed by us.
Todich Floral Design LTD endeavors to re-create the floral design and products that you have chosen as accurately as possible. However, the flowers and other products offered are subject to availability, as seasonal and supply changes will occasionally affect the floral designs and other items such as vases, pedestals, containers etc. Our floral bouquets and arrangements are handmade, so no two will ever be identical. Should the flowers you order be unavailable, we will provide a suitable alternative - matched in colour and variety, of similar or greater value without prior notice. Due to seasonal availability of flowers we can not make a commitment to any specific varieties of flowers being used. We undertake to supply the freshest, best quality flowers and foliage available in the colours requested and specified by the customer.We will try to meet any personal requirements communicated to us in person, by phone, or email.
We offer a trial period to enable you to see if our service suits your needs. This will include one floral arrangement FREE of charge and then a further continuous four weeks of arrangements that will be invoiced at the expiry of the trial.
We guarantee delivery by 1PM. Timed delivery if required is available but subject to extra charge.
Flower delivery will be made on Mondays unless agreed otherwise. Seasonally we may alter the delivery date without prior notice e.g. Christmas, New Year and Valentine's Day.
Due to the supply restrictions and difficulty accessing businesses between Christmas and the beginning of the New Year a plant display will be delivered at the value of two weeks budget. Access would be required to water the green plants after Christmas and before New Year.
The freshness of the flowers is guaranteed. If wilting occurs a full replacement will be made within twenty four hours of notice being given and without any extra charge. The replacement service is strictly restricted to the quality of flowers and it does not apply to replacement requests based on flower type and coulor choice not communicated to us prior to flowers being delivered or ordered for the specific customer. Flower variety and flower colour preference must be given to us minimum a week prior to delivery taking place. No replacement of a flower vase or flower display can be made without advance notice given for the specific flower colour preference and flower variety.
Vases will be changed seasonally and in accordance to flower designs and flower varieties. This will enable you to enjoy varied arrangements including tall flowers such as Birds of Paradise and short flowers such as Tulips. We can not be responsible for breakages and the loss of vases or other displays. If breakage or damage occurs while vase, container or other display is not in our possession and on hire to you on your premises or in your possession it will have to be replaced or will be charged for.
The budget for a single flower display can not be less then £25.00 (excluding VAT). If more than one arrangement is required for delivery to the same address the budget for additional flower displays may be less then the minimum £25.00 budget. The budget of fresh weekly arrangements can be increased with few days' notice, for any special occasions. The reduction of the budget will be accepted if it does not go below the minimum budget of £25 and if it is given a minimum 7 days in advance.
Competitive weekly prices are based on a continuous annual coverage and regular weekly supply for all 52 weeks in a calendar year. For that reason a break in service is not possible.
A cancelation of the service will require a minimum of four week's notice.
All weekly office customers will have access to our online ordering system and can place orders on our gifting web site http://www.flowers24hours.co.uk/ without need for using a credit card. The payment for these products would be added to your monthly invoice.
An itemised invoice will be issued at the end of each month. Credit terms are 30 days from the date of invoice. Payment methods are as follows: Cheque, BACS or direct bank transfer. Payment by credit card would attract a 3.5% fee.
A deposit of 20% of the total cost or £150 (whichever is greater) is required for a booking of a wedding or an event flower service.
Booking of your wedding or event service can only be confirmed by receipt of the deposit. In addition the deposit is the only way to secure our wedding and event service on your chosen date. All quotations are valid for 14 days from the date on the quotation unless stated otherwise in writing. If the deposit has not been paid within 14 days of the quotation date we reserve the right to take another booking on or around the date of your wedding or event. If, for any reason your wedding or event is cancelled this deposit is not refundable. If you decide to postpone your wedding we will hold your deposit until your wedding goes ahead but no longer than 6 months. The final payment is due no later than 14 days prior to the wedding or event date. If a wedding or an event is cancelled less than 14 days prior to the date of a wedding or an event only 50% of the total paid will be refunded. If a wedding or event is cancelled with less than 14 day's notice, no refund will be given. We reserve the right to cancel any wedding or event flowers, if full final payment is not made and does not appear in our bank account 14 days prior to the wedding or event date. We are not obliged to offer any compensation if the payment is not made by due date and no refund would be offered.
Colour, quantity and any design changes can only be made up to 14 days prior to the wedding or event and must be supplied to us and confirmed in writing. We reserve the right to apply a surcharge if radical changes to the original floral designs are being made. Delivery type and charges would be clearly indicated in the quotation supplied. An authorised person or card holder (if payment has been made with a card) should inspect the quantities and quality of the flower displays and sign for all delivered products as "received in good condition". Any complaint must be made at the time of the inspection and the time of receipt. We can accept no responsibility for any of the displays after signature for "received in good condition" has been received.
Any complaints must be communicated to us at the time of the delivery and during the recipient's inspection. Any complaints received after delivery took place and "received in good condition" signature has been entered can not be accepted and especially not after the event when displays had already been used.
We require a signature when you receive your flowers to say that they have arrived in perfect condition and that the number of products designs is correct as we can not take responsibility for items that are not under our control. If we are instructed to deliver flower designs and leave them at the requested delivery address without by us strongly recommended inspection and without obtaining the "received in good condition" signature full responsibility lies with the paying customer. Under such circumstances no complaint relating to quality or quantity of flower displays and other items can be accepted by us and full responsibility for any items missing or damaged is with the customer who has authorised such delivery. If customer or the authorised representative of the customer are not at the delivery location or can not be found at the vanue at the time of the delivery taking place, products will be left and no responsibility for quality and quantity of flower displays and other items can be accepted by us.
We reserve the right to take photographs and video footage of the flowers and other designs we supplied to your wedding or event, which may be used by us for promotional and advertising purposes.
Delivery time is approximate as outside influences cannot be controlled i.e. traffic and weather!
All props: candle holders, vases, urns, metal candelabras, night lights or any other hired items apart from the fresh flowers, foliage and candles are supplied on the basis of hire and at all times belong to Todich Floral Design LTD
We require a security holding deposit for all hired items by a separate payment made payable to Todich Floral Design. A deposit will be required to cover any loss or damage while in the hirer's possession. The security holding deposit will be returned after the event. once the hired items have been returned in perfect condition. If any of the hired items are damaged or missing on collection they will have to be replaced with the identical item or paid for in full. Hire charges are based on 24 hours hire unless stated differently in writing. We reserve the right to charge extra days hire if hired items are not returned to us or made available for collection by us.
Charges will be made for any glassware returned cracked, chipped or broken. The hirer is responsible for any loss or damage to the items while in hirers possession. Replacement of goods is charged at current purchase price. It is the responsibility of the hirer to reclaim any of these costs from the venue or the third party if the venue or the third party was at fault. Todich Floral Design LTD does not accept any liability for injury, loss or damage to the hirer or any third party. Insurance against theft or damage of hired items is not included. All packaging or/and boxes must be returned with the hired items. All hired Items are for indoor use only unless stated otherwise in writing.
If hired vases, props and other hired items cannot be collected at the agreed time, date we reserve the right to charge for any consequent collections.
All delivery items must include a full and correct address, postal code and name of the recipient and any specific instructions.For larger vanues or dificult to locate locations a full instruction must be given incuding any procedures that must be folowed. The customer is responsible for entering or giving us correct instructions and delivery details.We can not be responsible for any delays in delivery that may occure as the result of incorect and /or insuficient delivery instructions.
We do not accept liability for delay in delivery and issues with quantity and quality of flower displays after they where safly dropped at the requested delivery address in the event there is no-one to receive the order and sign for the delivery.If the recipient is not at the delivery location or can not be found at the venue due to insuficient delivery instructions the item(s) will be safly dropped and customer informed of the delivery.
All deliveries are standard deliveries unless otherwise agreed. A standard delivery is a delivery that takes place at any time on the chosen date. Specific timed deliveries and deliveries that include driver and/or florist waiting time are available but subject to additional charge.

We shall not be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.
We do not accept responsibility for any indirect loss, loss of enjoyment, loss of business, loss of goodwill whatsoever other than death resulting from our negligence.

You are entitled to see a copy of the personal information we hold about you and to correct any error or omission in it. Your request must contain enough details to enable us to identify and find your personal data.
